ive always wondered what it takes to be caught in copyright and trademark hocus pocus (ie law-breaking). well today i found out. incredible. this was definitely the highlight of my day. heck - my week. it started about 3 days ago when i tried to make a t-shirt with this sweet image above that has origins linked to 'obey the giant' and the never ending story (for more on obey the giant visit www.obeygiant.com) i was actually very excited about this t-shirt that i was going to wear supporting both obey and my childhood hero falcor. rock on falcor. but today those dreams were temporarily shattered when i recieved this email:

"...Thank you for placing an order with us at zazzle.com. Unfortunately, your order has been cancelled because it contains content that is in violation of United States copyright and/or trademark laws. Specifically, your order contains a product(s) with a copyright-protected image of Falcor from the Never Ending Story. No funds will be charged to your credit card for this order.

Generally speaking, we cannot fulfill any orders containing a copyright or trademark protected title, name, or image. Examples of infringing material include:
--pictures or names of celebrities;
--names of characters from books, films, or television shows;
--titles of books, feature films, television shows, or magazines;
--images from films, television shows, video games or the Internet...."

wow. they actually looked at my shirt - called me out - and went as far as to stop production. you mean someone else out there know who falcor is? i want to meet them. maybe they have a rocketpack as well. in the meantime i try another online shirt-printing company, so if you see me in the following weeks with a sweet shirt on - you know ill have overcome the man.

I believe that if you alter the image by 10%, you won't be infringing on copyright. :)I think I remember something like that from media law in college, er, um, I think...

amber - you're a dealer of this this kind of business for your work? do you specialize in disney characters?

no pa - wow - 10% is not much. but what about the names (ie falcor) ??
